GoldieBlox recently apologized for their usage of the Beastie Boys‘ ‘Girls’ in a promo for their line of toys for girls, but the band is not buying it. According to the New York Times, the band has followed through on plans to file suit against the toy company after the company first took legal action against them.

‘GoldieBlox achieved and continues to achieve additional publicity, press coverage and upon information and belief, greater sales of its products, as a direct result of the Beastie Boys’ perceived affiliation with the GoldieBlox Advertisement,” reads the lawsuit. “Unfortunately, rather than developing an original advertising campaign to inspire its customers to create and innovate, GoldieBlox has instead developed an advertising campaign that condones and encourages stealing from others.”

To recap, the company issued the clever promo with revamped lyrics to the song ‘Girls’ and when the Beastie Boys reached out to find out about the music, they filed a pre-emptive suit against the band to establish their rights to the promo. After the band went public with the company’s actions and made it clear that the late Adam Yauch’s will prohibited the use of the band’s music in commercials, the Goldieblox company attempted to make nice.

The company issued an apology to the band, took the video down and stated that they would drop their legal action, even though they felt their promo fell under “fair use,” if the band would promise not to pursue legal action against them.

The Beastie Boys maintain that the company’s conduct has been “intentional and willful,” and they feel that they will continue to suffer damages as a result of the usage and copyright infringement. You can check out the full lawsuit here.
